1. Acceptance of Terms

By downloading, installing, or accessing the NxtGen POS mobile application, web portal, or associated cloud services (the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the Services.

2. Software License & Permitted Use

NxtGen POS grants you a non-exclusive, non-transferable, revocable license to install and use our Point of Sale software on compatible mobile phones, tablets, and commercial POS hardware strictly for your lawful internal business operations.

3. Merchant & Cashier Responsibilities

• You are responsible for maintaining the confidentiality of your employee and manager credentials.
• You are solely responsible for ensuring that product prices, sales tax calculations, discounts, and menu items configured in your account comply with local laws and regulations.
• You must verify cash drawer opening counts, register balancing reports, and card terminal receipts during daily operations.

4. Offline Mode & Data Synchronization

While NxtGen POS provides offline resilience, you acknowledge that certain cloud features (e.g., real-time inter-branch stock updates, remote web reporting) require active internet connectivity. You agree to reconnect your devices periodically to ensure complete data synchronization.

5. Third-Party Hardware & Payment Processors

NxtGen POS integrates with third-party payment gateways, card terminals, and ESC/POS thermal printers. We are not responsible for transaction declines, hardware malfunctions, or fee structures established directly between you and your merchant payment acquirer.

6. Limitation of Liability

To the maximum extent permitted by applicable law, NxtGen POS and its officers shall not be liable for any indirect, incidental, or consequential damages resulting from lost profits, business interruptions, data sync delays, or hardware failure.
